As of today we are announcing a release on CD by Chuck Schuldiner's CONTROL DENIED.
It will feature incomplete, unfinished recordings which were meant for the new album, which unfortunately was never finished, at least up until the moment of this press-statement.
We have requested to get the Mastertapes on these recordings, but Chuck's family do not wish to communicate or talk with us anymore, let alone send us the Master tapes (which are 75% finished) that should have been with us long ago.
Probably there will be a lot of talk and discussions appearing, which we can understand obviously, but a fact is that we signed a contract with Chuck that he was very happy about, paid the full advance in 2000, have been asking for a solution during 2002 and 2003, but in all honesty we never really got a reply.
The only honest and valid reason why the "real" album by CONTROL DENIED is still not released is very simple; the legal heritors of Chuck (= his family) refuse to do anything concerning this release, if they will claim differently it is time for them to prove us wrong, we have been waiting for 18 months. I think they should stop fooling around with the record-label and the fans, the time to act in honesty is now or never !!! We are not lying, not cheating and in no way disrespectful, if someone disagrees he will need to prove us wrong, it is in the hands of Chuck's family.
Possible release date is: spring 2004.
Now let us see on a few topics guided by Jane Schuldiner's statement (from September 7th 2003) on the website EMPTY WORDS, because I have many questions on this. (check: www.emptywords.org/NEWS.htm), the quotes are direct from Jane Schuldiner.

: I indeed had the chance to speak with Jane a lot of times (during the first half of 2002), and it were nice conversations, with Bethan I only spoke three times, with a total time of 30 minutes I think. The third conversation Bethan took the phone and said I should never call again. Until today I still do not know why ??? Can anyone tell me ???

: in all honesty I do not know what their position is on Chuck's work. They never explained this to me, so what is the position of the Schuldiner family and what does Chuck's will actually say ?

: we were asking for months for a legal contact on these matters, and we never until November 17th received anything ever from an attorney related to the Schuldiners. After announcing to spread this press-release we received a letter from their attorney within days. Need I say more ?

: what are those promises, no one ever told me what Chuck said in his testament or his will ??? Easy to claim you are fulfilling Chuck's last promises, but no one knows what these look like, right ? And releasing the album a.s.a.p must be a joke, since the family received the Master tapes from Jim Morris already in December 2001 and since then they have not even called the studio once, nor did any of the other musicians involved ever got an invitation to finish the album.
Six quotes that I would like to see answered in a justified/honest way, not claiming something without any proof, making us look like the unwilling party in this conflict.
Jane Schuldiner, the mother of late DEATH/CONTROL DENIED frontman Chuck Schuldiner, is making available a professionally-edited video of her son at various points of his life to anyone that is interested in obtaining a copy. Here is Ms. Schuldiner's official statement on the matter:

“There was a video, professionally done, made of the different stages of Chuck's life from the beginning to the end, to be shown at Chuck's memorial on January 4, 2002. This was a wonderful testament to him and I have decided to share it with any of you who wishes to have it. Despite the recent passing of CONTROL DENIED mainman Chuck Schuldiner, the remaining members of the group—bassist Steve DiGiorgio, vocalist Tim Aymar, guitarist Shannon Hamm, and drummer Richard Christy—appear determined to complete work on the band's long-awaited sophomore effort, entitled When Machine and Man Collide, for a late 2002 release through Hammerheart Records. According to reports, the drums and most of the guitar parts have already been laid down (Hamm is said to have only “a few touch-ups” left to do), and DiGiorgio and Aymar are waiting to record their parts, after which the album will be mixed and mastered. As Steve himself indicated in his touching tribute to Chuck (originally posted here on December 20th), “it's sad beyond belief that [Chuck] never saw [the album] to its completion. We will try our best to finish it in his honor, but will never know if it lives up to his standards. That's the least we can do for someone who gave so much and cared so much about what he did and how it affected those who believed as well.”
Many of you will recall that when we started our fundraising efforts, approximately 3 months ago, that DEATH/CONTROL DENIED founder, Chuck Schuldiner, was brought to Los Angeles to take part in a trial for a still experimental chemotherapy agent called Vincristine. Although the family was assured that the drug is virtually non-toxic in nature, the large dosage which Schuldiner received over the span of five days did indeed poison him, causing residual difficulties and weakness which he has been recovering from since. These effects are all considered to be temporary and in fact Chuck is making progress and gaining his strength back day by day. We're expecting Chuck is now receiving follow-up treatments of a related but milder drug in an effort to eradicate any further cancer cells that remain, although the outcome of that treatment cannot be assessed at this time.

Bassist extraordinaire Steve DiGiorgio (i.e. TESTAMENT, SADUS, ICED EARTH, CONTROL DENIED) has posted the following update on his official web site: “The ICED EARTH album, Horror Show is done and awaiting a mid June release on Century Media. I am no longer working on [WATCHTOWER guitarist Ron Jarzombek’s] SPASTIC INK project... Don't ask. CONTROL DENIED's newest recording is still in limbo because of some weird scheduling problems. But some of it is done, and we'll be finishing it up in the coming months. We're right in the middle of the recording of DRAGONLORD [featuring TESTAMENT’s Eric Peterson on guitar/vocals, plus most of the remaining TESTAMENT members, minus vocalist Chuck]. Drums and most of the guitars are done. I'll be starting bass this week sharing time with Lyle's keyboards. TESTAMENT hasn't officially pulled out of the shows coming up at the end of May/early June [in Europe]. We're waiting on Chuck [Billy]'s word and condition. For those of you who don't know about what's befallen Chuck, you can read all about it on www.testamentlegions.com. Writing is still going on between me and Darren for the new SADUS album. Slowly, but slowly.”
CONTROL DENIED’s sophomore effort, tentatively titled When Machine And Man Collide, has had its release date pushed back until sometime after the summer, according to the group’s record label Hammerheart Records. No specific reason was given for the delay, but one can only speculate that the hectic schedule of bassist Steve DiGiorgio (who is keeping himself busy with both TESTAMENT and ICED EARTH when not playing with Chuck Schuldiner and co.) might have been a factor. Either way, the remaining guitar tracks for the are going to be recorded next month, while “exact scheduling for Steve's sessions is still being worked out”. The CD’s artwork is being done by the immensely talented Travis Smith, who also co-designed the artwork for CONTROL DENIED's debut CD, The Fragile Art of Existence.
Control Denied has signed to Hammerheart Records. Band's sophomore release, titled "When Machine and Man Collideis", now underway in Tampa's Morrisound Studios with producer Jim Morris at the board. Chuck Schuldiner naturally resides at the helm of Control Denied. Contrary to the ever-churning rumor mill, Steve DiGiorgio (bass) and Richard Christy (drums) are still full-time members of Control Denied. Their participation in other projects (i.e. Iced Earth) has not and will not take away from their involvement in the band. Smoothing out the returning line-up are Shannon Hamm (guitar) and Tim Aymar (vocals). Chuck had this to say: "This album will not contain any guest rappers, 7-string guitars, baggy pants or any other elements from so-called "New Metal". Control Denied is not a power metal band and it is not a side project. This album will crush those misconceptions completely! I believe more than ever that this album will embrace my musical past while once again taking a step forward into the future. This is something for all true Metal fans."
